YOUR MEMBERSHIP ACCOUNT

ORDERS
All orders are subject to approval and acceptance by Service Provider and Service Provider shall not be liable to Service Receiver or any other party by reason of its failure to accept any order. After acceptance of any order by Service Provider, any order or part thereof may not be terminated by Service Receiver unless prior, written consent is granted by an authorized agent of Service Provider. Service Receiver needs to support Service Provider by providing at the time of order complete End-Use Information.
TERMS OF SALE
Service Receiver shall be charged at prices quoted, provided Service Receiver’s order is received during the effective period of a price quotation, at the prices in effect on the date of Service Provider’s acceptance of order for such services. Service Receiver may be subject to fees for incorrect orders. Service Receiver requested order changes require Service Provider's prior written consent. The risk of loss of items purchased by you passes to you upon Bookshoppe’s delivery of the items to the service receiver.
REVIEWS, COMMENTS, EMAILS, AND OTHER CONTENT
Visitors may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." RISK OF LOSS
All items purchased from BOOKSHOPPE are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
DELIVERY
Service Provider shall use reasonable efforts to satisfy delivery dates specified by Service Receiver, subject to timely availability of all the desired support from the Service Receiver.
INDEMNIFICATION
Service Receiver shall indemnify and hold harmless Service Provider, its affiliates, directors, officers, agents and employees from any claim, loss, or damage, including attorneys' fees, asserted by any third party due to or arising out of any action or inaction of Service Receiver, its employees or agents.
DISCLAIMER
The information contained in this website is for general information purposes only. To the fullest extent permitted by law Service Provider disclaims all warranties, express or implied, including without limitation for non-infringement, merchantability, satisfactory quality and fitness for purpose.

ARBITRATION
All disputes, differences and/or claims arising out of this Service Agreement shall be settled by Arbitration in accordance with the provisions of Arbitration and Conciliation Act, 1996 or any statutory amendment thereof. The Dispute shall be referred to the Sole Arbitrator who shall be appointed by the Authorized person of Service Provider. The Client shall not challenge the nomination of Arbitrator or his award on the ground that the nomination is made by Authorized person Service Provider .The Arbitration proceedings shall be held at Delhi, India and the arbitration shall be conducted in English Language. The award of the Arbitration shall be final and binding on the Client and Service Provider.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, such as our Shipping Policy, posted on this site. These policies also govern your visit to BOOKSHOPPE. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
MISCELLANEOUS
All communications required or permitted under this agreement must be in writing and will be deemed given when (a) delivered personally, (b) sent by confirmed telex or facsimile, (c) sent by commercial overnight courier with written verification of receipt, or (d) sent by registered mail, return receipt requested, postage prepaid.
This agreement may not be amended except by a written instrument signed by appropriate officers of each party.
A few other things to keep in mind are: a) Service Provider’s opinion on all issues pertaining to the interpretation of these Terms shall be final and binding on Service Receiver, (b) The relationship between Service Provider and Service Receiver is governed by the laws of India and exclusive jurisdiction of the courts in Mumbai. (c) Service Provider is subject to existing laws and legal process and nothing contained in these Terms is in derogation of Service Provider right and obligation to comply with the Law or governmental, court and requests of enforcement agencies, (e) If any part of these Terms are held to be invalid or unenforceable including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and is nevertheless valid an enforceable and the remainder of these Terms shall continue in effect, (f) Service Receiver may not assign any rights or obligations against Service Provider without Service Provider's prior written consent. (f) Service Provider shall not be responsible for any delay or deficiency due to any force majeure events such natural disasters, acts of terrorism, civil labor strife, labor and transportation strikes, (g) Nothing in these Terms obliges Service Provider to provide any credit to Service Receiver.
